Client-controlled information

In some consulting, leadership-development, assessment, or executive-search engagements, ClimbWizely may process personal information on behalf of a client organization. The terms of a consulting, coaching, search, or other client agreement may also contain additional confidentiality and data-handling provisions. To the extent permitted by law, those terms apply to information collected specifically through that engagement.

Information you provide directly

The information we collect depends on how you interact with us.

Contact and inquiry information

When you contact us through the website, by email, by telephone, through a scheduling service, or through another communication channel, we may collect:

When you subscribe to The Weekly Climb or another ClimbWizely communication, we may collect your email address, subscription preferences, and information about how you interact with our communications, such as whether a message was delivered, opened, or selected.

You can unsubscribe from marketing emails at any time using the link included in each message.

Assessment information

When you complete a ClimbWizely assessment, we may collect your answers, assessment results, and related technical information.

The current website assessment can be completed without providing an email address. If you subsequently subscribe, contact us, or request a tailored response, we will collect the contact information you choose to provide.

Assessments are intended to provide general guidance. We do not use assessment responses to make solely automated decisions that produce legal or similarly significant effects concerning you.

Coaching, consulting, and program information

When you participate in coaching, consulting, leadership development, workshops, assessments, or advisory services, we may collect information relevant to the engagement, including:

• Business, organizational, and operational information;

If you create an account or use a client, member, or program portal that we may make available, we collect the information needed to establish and maintain that access, such as your username or login identifier, authentication credentials, contact details, role or permissions, and records of your activity within the portal, including sign-in history, features used, and content you upload or submit. We use this information to provide the portal, authenticate access, maintain security, and support your use of the Services.

Public posts and community features

If we introduce public posting, comments, discussion boards, reviews, or other community features, any information you choose to post publicly through those features may be visible to other users and to the public, and may be collected, used, and retained as described in this notice. You should exercise care regarding the information you choose to make public, and you should not post information you wish to keep confidential.

Recorded workshops, programs, and events

Workshops, programs, coaching sessions, calls, presentations, and other events may be recorded for delivery, quality, training, or recordkeeping purposes. A recording may capture your participation, including your name, image, voice, and any comments or materials you share. Where notice or consent is required by applicable law, we will provide it before recording, and you may decline to appear on camera or to speak where a session permits.

Where appropriate and permitted by law, relevant candidate information may be presented to the client organization conducting the search.

Deliver newsletters and requested content

We use subscription information to send The Weekly Climb and other content you have requested. We may also use engagement information to understand which topics are useful to our audience.

Operate assessments

We use assessment responses to generate results, identify potentially relevant ClimbWizely services, and improve our assessment tools.

Operate and improve the website

Protect ClimbWizely and others

ClimbWizely does not sell personal information or share personal information for cross-context behavioral advertising as those terms are defined under applicable U.S. state privacy laws. Where applicable law requires us to recognize another legally valid browser-based privacy signal, we will process it as required.

We do not store full payment-card numbers; we may retain limited transaction records, such as the date, amount, and a confirmation reference, for accounting, tax, and recordkeeping purposes.

Clients

In executive-search, succession, assessment, and related engagements, we may disclose relevant candidate or participant information to the client organization for which the work is being performed. When we process employee, participant, or candidate information on behalf of a client, the client’s instructions and privacy practices may also apply.

Professional advisers

We may disclose information to attorneys, accountants, insurers, consultants, and other professional advisers where reasonably necessary for their services.

Legal and safety disclosures

We may disclose information when we reasonably believe disclosure is necessary to:

ClimbWizely does not sell personal information for money. ClimbWizely also does not disclose personal information to third parties for cross-context behavioral advertising or for those third parties’ own direct-marketing purposes.

We do not provide newsletter subscriber addresses to other companies for their own marketing. We may provide subscriber information to an email-service provider that processes the information on our behalf to deliver the newsletter.

If these practices change, we will update this notice and provide any choices required by applicable law before beginning the new practice.

8. International Processing and Transfers

ClimbWizely and its service providers may process information in the United States and in other countries where they operate. The privacy and data-protection laws of those countries may differ from the laws where you live. Where applicable law requires additional protections for an international transfer, we will use an appropriate legal mechanism or contractual safeguard.

9. How Long We Retain Information

• Newsletter information is generally retained while you remain subscribed. After you unsubscribe, we may retain limited information on a suppression list so that we can honor your request.
• Inquiry and prospective-client information may be retained for a reasonable period after our last interaction.
• Client and engagement records may be retained for the duration of the relationship and afterward as required for contractual, accounting, tax, insurance, or legal purposes.
• Candidate information may be retained for the applicable search and for a reasonable period afterward for relevant professional opportunities, recordkeeping, and legal compliance.
• Website logs and analytics information are retained according to operational needs and the settings of the relevant service providers.

When information is no longer needed, we take reasonable steps to delete, destroy, or deidentify it.

ClimbWizely has not sold these categories of personal information or shared them for cross-context behavioral advertising during the preceding 12 months. We do not knowingly sell or share the personal information of individuals under 16.

This section applies only to the extent that an applicable state privacy law grants you the described rights. Its inclusion does not necessarily mean that ClimbWizely meets the applicability thresholds of every state privacy law.

13. Children’s Privacy

The website is intended for a general business and adult audience and is not directed to children under 13. We do not knowingly collect personal information online from children under 13. If we learn that such information has been collected without legally sufficient authorization, we will take reasonable steps to delete it.
